Abstract: Evidence collection and presentation in court are essential to any cybercrime investigation. Unfortunately, this is a complex process, especially in cybersecurity cases. The global spread of cybercrime spans across several jurisdictions and poses jurisdictional issues. Further, cyberattackers often start by having an edge in terms of the usage of sophisticated technologies. Law enforcement agencies handling cybercrimes need additional care in handling evidence. It is common for the judiciary to take help from expert cybersecurity professionals to guide them in collecting and presenting evidence in a trial. Cybersecurity professionals must be careful when translating technical jargon to non-technical audiences in court. They need to know how to respond to cross-examination by anticipating challenges and using effective rebuttal strategies. This chapter discusses two case studies – one on SolarWinds in the context of cyber espionage and another on Wirecard in financial fraud investigation. Insights shared in this chapter help the cyber professional and legal communities effectively handle cybercrime cases.
